How To Legally Remove Medical Debt Collections From Credit Report

Most Medical Debt Collection Companies Are Illegally Reporting On Your Credit Report! This means that if you have a medical debt collector reporting a negative account on your Credit, you may be able to get this account removed! First off, make sure that you have a recent copy of your credit report from the 3 major credit bureaus. You can order it here. It is extremely important that you obtain the most recent credit report! Credit Reports are constantly changing and if you have one from 2 weeks ago, or a month ago, it’s just not going to give you the full picture. A lot can change in 2 weeks!

How To Remove Medical Debt Collections From Credit Report…

I am going to show you exactly what you need to do to audit your credit and remove a medical debt collection account from your credit report. First, you need to get a copy of your report here… You want to go to the bottom of the credit report where it says “Collections Accounts.” Look over each account and find out if the Negative Account has reported to any of the three major credit bureaus, Equifax, Experian or Transunion.

My first and most important words of advice; DO NOT PAY THE DEBT COLLECTOR until you have read the steps below or scheduled a free credit consultation with us! My second words of advice; You should never dispute your credit online… You can read about that too, but you want to do everything in writing, you don’t want to risk making any mistakes.

The Medical Debt Collector Is Reporting On My Credit

If the Medical Debt Collector is reporting negative information on your credit (such as an unpaid collections account), write down the name of the Debt Collector and the name of the original creditor or medical center. Write down the original balance and the current balance (Debt Collectors charge interest, so this amount is always going up). Go to the part of the report that says “inquiries.” If you see any Inquiries from any Debt Collectors, write it down. All this information is important and will be used to help get this account deleted from your credit report. *When we work with clients, we collect this same information for our Fair Credit Reporting Act Attorney to review. He finds all the violations and forces the Debt Collector to remove the account and pay a settlement to YOU!  🙂

There Is No Medical Collection On My Credit Report

You don’t see any Medical Debt Collection on the report? Good. But, we don’t stop there. Have you been receiving Phone Calls from any of those pesky debt collectors? How about letters? Yes? Great! Here is what you do. Save ALL voicemails and letters. Take screenshots from your cell phone or pictures of your caller ID each time they call. Do they have an automated system calling you? Great! Write that down too, it’s a MAJOR violation.

Gather as much information as possible, we can use this evidence against them to and negotiate with the collector to remove the account from your Credit Report. Debt Collectors have to follow specific laws and procedures for every phone call they make and letter they send. Debt Collectors usually don’t follow the rules. Did you know, it’s illegal for a Debtor to call you at work, on a cell phone, after 8pm, or on Sundays!!??… The list goes on. They have to recite a paragraph before they are allowed to speak to you. So, like I said, hold onto all evidence! You might not think it’s evidence, but it is.

How To Fight Back Against Medical Debt Collectors

After you have gathered the information on the medical debt collection account, there are steps you need to take to get it removed from your Credit Report. First off, do not talk to debt collectors, just acknowledging a debt can re-age it and destroy your credit scores. Only communicate through US Mail (preferably certified mail). I highly recommend setting up a Free Credit Restoration Consultation with one of our professionals. That way you can have us map out a plan of action for you. We even have an attorney that will work on your file at no extra cost, if he finds Legal Violations, he makes the Debt Collector pay a settlement. If they pay the settlement, you get paid! Lots of consumers are using form letters and disputing online and making their situation worse.

Remove Medical Debt Collection From Credit Report

But as I promised, I’m going to tell you How To Legally Remove Medical Debt Collections From Your Credit Report.

Medical Debt Collection Removal Steps…

Here are the steps you need to take to get a medical debt collection account removed from your Credit Report.

Debt Collection Advanced Disputes

For these advanced disputes to work, you need to send them simultaneously. The Fair Credit Reporting Act states that creditors and debt collectors have 30 days to respond to your disputes. If they do not verify the information within the 30 day time period, they must delete the information from your Credit Report. If you send both disputes at the same time, the Creditor is mandated to respond to you before responding to the Credit Bureaus – further lengthening the timeframe and workload for both the Credit Bureaus and Debt Collectors.  *We don’t recommend doing this without the help of a professional.

Debt Validation Letter

You want to send a debt validation letter directly to the Debt Collector. It’s preferred that you send this letter within 30 days of the Debt Collector attempting to contact you. But, legally, you can send this letter at anytime. You can find Debt Validation Letter Templates Here. You want to send it certified mail – they are required respond within 30 days of the receipt of your letter – or the account is automatically removed from your credit report. Just BE CAREFUL and do your research. Sometimes these letters can hurt or cause the Debt Collector to sue you if you don’t do it properly. Debt Validation Letters are intended for the Debt Collector to prove you owe the said debt and show you all supporting documents. Similar to filing a ‘Discovery’ at a courthouse.

Credit Dispute Letters

You want to send a Credit Dispute Letter to the three major Credit Bureaus. You can find a Credit Dispute Letter Template, Here. Each letter must be unique, handwritten, or typed on personalized letterhead. You want to send all letters Certified Mail with a Return Receipt. Keep copies and records of everything. The more information you have, the more evidence you have to negotiate a deletion from your Credit Report.

Better Business Bureau Complaint / Dispute

You want to go online and file a complaint about your Medical Debt Collector on the BBB Website. Address your concerns with the Better Business Bureau 3 days after you send the dispute letters. They will reach out to the company, and typically advocate for consumers. The Debt Collector is not mandated to respond to the Better Business Bureau, but if they don’t it will go on their BBB record. This is just an extra step that makes the collector have to do more work on your file. If you want help or you’d like a professional to take a look at your situation, read below:
